1. Parties

This Distance Sales Agreement (the "Agreement") is concluded electronically between the SELLER identified below and the BUYER identified in the order form, in accordance with Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

flowereast.com (the "Platform") is the e-commerce environment through which the SELLER's products are offered to consumers. This Agreement is concluded between the BUYER and the SELLER identified above. Sourcing, preparation and delivery of the ordered product, as well as liability for defective goods, rest with the SELLER. The Platform is operated by the company identified below, acting as an intermediary service provider under Turkish Law No. 6563 on the Regulation of Electronic Commerce.

BUYER

The person whose name, delivery address, phone number and email address are stated in the order form. The BUYER confirms that the information provided is accurate and complete.

2. Subject of the Agreement

The subject of this Agreement is the sale and delivery by the SELLER of the products and/or services ordered electronically by the BUYER through the Platform, whose characteristics and price are stated in the order summary, and the determination of the rights and obligations of the parties.

3. Price and Payment

• The sales price of the products, including all taxes, is shown in the order summary.
• For international deliveries the amount is calculated using the exchange rate valid at the time of the order; that rate is fixed to the order.
• Payment is processed through 3D Secure infrastructure of licensed payment institutions. Card details are never stored on the SELLER's systems.
• If payment fails for any reason, the SELLER is released from the obligation to deliver.

4. Delivery

Delivery is made to the address given by the BUYER, on the selected delivery date and, where applicable, within the selected time slot. Full delivery conditions are set out in the Delivery Terms page, which forms an annex to this Agreement.

Due to the perishable nature of flowers and similar products, if the recipient is not present at the delivery address, the product may be handed over to a relative, neighbour or building attendant at the same address; delivery is deemed completed in such cases.

5. Right of Withdrawal and Its Exceptions

As a rule, the BUYER may withdraw from the Agreement within 14 (fourteen) days of delivery without giving any reason and without penalty.

However, pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for:

• perishable goods or goods liable to expire (including cut flowers, floral arrangements, live plants, cakes and food products),
• goods prepared according to the BUYER's specifications or personalised for the BUYER,
• goods unsuitable for return for reasons of health or hygiene once their packaging has been opened.

6. Order Cancellation

Orders that have not yet entered preparation may be cancelled free of charge before the delivery date. Cancellation requests for orders already in preparation or dispatched may be refused.

7. Defective Goods and Complaints

If the delivered product is defective, the BUYER should notify [email protected] within a reasonable period, ideally within 24 hours of delivery given the perishable nature of the products, and where possible attach a photograph.

8. Protection of Personal Data

The BUYER's personal data is processed under Turkish Law No. 6698 for the performance of the order and compliance with legal obligations. See the Personal Data Protection Notice.

9. Dispute Resolution

Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence or at the place where the transaction was made are competent, within the monetary limits announced annually by the Turkish Ministry of Trade.

10. Entry into Force

By ticking the confirmation box in the order form, the BUYER declares that they have read, understood and accepted this Agreement and the Preliminary Information Form. The Agreement enters into force upon confirmation of the order by the SELLER.
